Kuwait Tightens Car Rental Rules to Protect Consumers

The Ministry of Commerce and Industry has unveiled updated car rental regulations aimed at safeguarding consumers and promoting transparency.

Announced Thursday, the rules include a ban on promissory notes, mandatory comprehensive insurance, and photo documentation of the vehicle's condition at both pick-up and return.

Ministry Undersecretary Ziyad Al-Najim highlighted that Ministerial Decision 231/2024, issued by Minister Khalifa Al-Ajeel, seeks to streamline car rental contracts by ensuring fair and clear terms for renters. One significant update mandates renters and lessors to document the car’s condition with photos or videos before and after the rental period.

Eliminating Hidden Costs
The decision prohibits the use of promissory notes and vague financial clauses, which previously left renters vulnerable to unexpected liabilities. Additionally, rental companies must deliver cars in top mechanical condition, fully equipped with safety essentials like spare tires and emergency tools.

Documenting Liability
Any pre-existing damage must be recorded, and new damages during the rental period will be assessed by the dealership to determine repair costs. Renters are obligated to return vehicles in their original condition, accounting for normal wear and tear, and must cover costs for lost items or damages not under warranty.

Rules for Repairs and Accidents
In case of accidents, renters must obtain Ministry of Interior approval for repairs and cannot proceed without the lessor’s written consent. If a car is confiscated due to the renter’s actions, the renter will bear daily rental fees during the confiscation and any related damages.

Consumer Rights Strengthened
The decision also ensures renters receive a clear copy of their contract, which outlines all rights and responsibilities. Renters are no longer required to sign additional promissory notes or financial documents beyond the rental agreement.

These changes mark a significant step toward greater consumer protection, ensuring smoother, more transparent car rental experiences across Kuwait.
